Hi Tek Information Services does not monitor, resell, rent, or trade any personal information provided by it's customers. We consider all customer furnished information as personal and confidential. We do not monitor any searches performed by our customers, or release any personal information to any third parties.
You must read and agree to these
terms and conditions before you enroll to " The ultimate
Internet Spy Tool".
This a service of Hi-Tek Information Services, hereinafter know as "H.T.I.S."
Please read them carefully.
1. By enrolling in this Premium Service (hereinafter "Spy
Tools"), you become an annual subscription customer ("Subscriber"),
or a "FLAT RATE" customer (collectively called "Customer")
and agree to be bound by this Agreement ("Agreement").
This Agreement is subject to change by "H.T.I.S." at
any time. Notice to Customers shall be made by adding any changes
to this "Terms and Conditions" document, which will
remain posted at the Site. Customers agree to review these "Terms
and Conditions" from time to time for changes and updates.
2. The following fees will be incurred by the customer: Subscription
Fees: The annual Subscriber is responsible for paying the annual
subscription fees according to the then-current billing terms.
Due to the amount of data, files, and downloadable programs from
within the site, Subscription fees are non-refundable.
2a. Customer will not be billed again for an annual subscription,
until the customer is notified by H.T.I.S. that their annual subscription
is due, and customer confirms a renewal subscription.
3. Customers may not assign or transfer access privileges to any
other person or entity. Customers must promptly inform "H.T.I.S."
of the following: changes in the expiration date of any credit
card used in connection with this Service; changes in home or
billing address; apparent breaches of security, such as loss,
theft, or unauthorized disclosure or use of an ID or password.
Until "H.T.I.S." is notified by e-mail of a breach in
security, the Customer will remain liable for any unauthorized
use of the Service. Upon request, Customers will be given access
to billing records that support charges for use of the services
of "H.T.I.S." .
4. All Customers are responsible for providing all personal computer
and communications equipment necessary to gain access to "H.T.I.S.."
Access to and use of "H.T.I.S." is through a combination
of user ID and password. Each Customer must keep his password
strictly confidential. Remember your password! For security reasons,
"H.T.I.S." will not release passwords to any other party,
except as may be specifically required by law or court order.
Unauthorized access to the Service is a breach of this Agreement
and a violation of law.
5. Any liability of "H.T.I.S." including, without limitation,
any failure of performance, error, omission, interruption, deletion,
defect, delay in operation or transmission, communications line
failure, theft or destruction or unauthorized access to, alteration
of, or use of records, whether for breach of contract, tortious
behavior, negligence, or under any other cause of action, shall
be strictly limited to the amount paid by or on behalf of the
customer to "H.T.I.S." for the preceding annual subscription.
Some states do not allow the limitation or exclusion of liability
for incidental or consequential damages, so the above limitation
or exclusion may not apply to you.
6. No warranty is made by "H.T.I.S." regarding any information,
services, or products provided through or in connection with the
"Spy Tools", and "H.T.I.S." hereby expressly
disclaims any and all warranties, including without limitation:
1) any warranties as to the availability, accuracy, or content
of information, products, or services; 2) any warranties of merchantability
or fitness for a particular purpose. Some states do not allow
the exclusion of implied warranties, so the above exclusion may
not apply to you.
7. The material on "H.T.I.S." is for the private, non-commercial
use of customers only. Any other use is strictly prohibited and
is a breach of this Agreement.
8. Customers agree not to submit, publish, or display on this
Site or any other, any defamatory, inaccurate, abusive, threatening,
racially offensive, or illegal material. Transmission of material
which violates any federal, state, or local law, is strictly prohibited
and is a breach of this Agreement.
9. Notices by "H.T.I.S." to Customers shall be given
by means of electronic messages (e-mail) or by a general posting
on the Site (which includes the updating of this "Terms and
Conditions" document). Notices by Customers to "H.T.I.S."
shall be given by electronic messages (e-mail) unless otherwise
specified in the Agreement. All questions, complaints, or notices
to "H.T.I.S." by means of electronic message must be
sent to snoopmaster@hitekinfo.com
10. The Customer hereby warrants and represents that he or she
is over the age of 18, and in all respects is qualified and competent
to enter into this Agreement.
11. This Agreement contains the entire agreement between the Customer
and "H.T.I.S." regarding the use of the Service, and
supersedes all prior written and oral understandings and writings,
and may only be amended upon notice by "H.T.I.S." to
Customers as described herein. Unless otherwise explicitly stated,
the provisions of this Agreement shall survive its termination.
The Agreement shall be governed pursuant to the laws of the State
of California.
I, the customer, under penalty of perjury solemnly declare and
affirm as follows:
A. Use of available data may be subject to FCRA and other applicable
law.
B. I subscribe to the principles
of the First Amendment which holds that free adult Americans have
the right to decide for themselves what they will read and view
without governmental interference.
C. I understand that information contained in electronic databases may not be accurate and/or reliable on any specific party and I hereby declare that I shall not hold H.T.I.S accountable for any misinformation or incomplete data obtained from any information contained in "The Ultimate Internet Spy" site.
D. I will not sell and/or in any way redistribute any contents of this site
E. I will not attempt to by-pass any security and/or access feature at this site.
F. If I use these services in violation of the above agreement, I understand I may be in violation of local and federal laws and am solely responsible for my actions.
G. By logging on, I will have released and discharged the providers, owners and creators of this site from any and all liability which might arise.
